This document is drafted to describe accurately how this site actually operates, but it is a template and not legal advice. 1. Acceptance and eligibility

By accessing or using this website, submitting a form, or otherwise interacting with FloodReady Florida ("we," "us," "our"), you agree to be bound by these Terms of Use and by our Privacy Policy, which is incorporated here by reference.

You must be at least 18 years old and legally able to enter into a binding agreement. If you submit information about a property, you represent that you own it, occupy it, or are otherwise authorised to request services relating to it.

2. Permitted use of this site

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use this site for your own informational and household purposes. Within that licence you may:

  • Read, print, and save pages for your own reference.
  • Share links to our pages.
  • Quote short excerpts with attribution and a link to the original page.
  • Submit a request to be connected with a licensed professional.

3. Prohibited conduct

You agree not to:

  • Copy, republish, scrape, or systematically harvest the content of this site, or use it to train a model or build a competing product, without our written permission.
  • Submit information that is false, or that belongs to another person without their permission — including entering someone else's phone number.
  • Use this site to solicit business, distribute advertising, or contact our readers.
  • Attempt to gain unauthorised access to any part of the site, its servers, or any connected system.
  • Interfere with the site's operation, including by automated submissions, denial of service, or introducing malicious code.
  • Remove, obscure, or alter any legal notice, disclosure, or attribution.
  • Use this site in any way that violates any applicable law, including telemarketing, consumer protection, insurance, or contracting law.

4. No professional advice

The content on this site is general consumer information. It is not professional advice and must not be relied on as a substitute for it.

  • Not insurance advice. We are not an insurance agency, insurance agent, broker, or public adjuster, and we are not licensed to transact insurance in Florida or any other state. We do not sell insurance, quote premiums, compare specific policies, evaluate coverage, or advise on claims. Under Florida Statutes § 626.854, preparing, filing, negotiating, or settling an insurance claim on another person's behalf for compensation is the work of a licensed public adjuster; we do not perform that work and nothing on this site should be read as an attempt to.
  • Not construction, restoration, or remediation services. We are not a contractor, water damage restoration company, mold assessor, or mold remediator. We do not inspect, diagnose, dry, demolish, remediate, or repair anything.
  • Not legal, medical, engineering, or financial advice. Health, structural safety, and legal questions require a qualified professional who can examine your specific situation.
  • Emergency situations. Nothing on this site is a substitute for emergency services. If there is a risk to life or safety — gas, live electricity in water, structural collapse, rising water you cannot stop — leave and call 911.

5. No agency, client, or professional relationship

Using this site, reading it, or submitting a form does not create:

  • an agency relationship between you and us;
  • an insurance agent-client or broker-client relationship;
  • an adjuster-insured relationship;
  • a contractor-customer relationship;
  • an attorney-client relationship; or
  • any fiduciary duty owed by us to you.

We do not act on your behalf, we do not represent you to any insurer or contractor, and we have no authority to bind you or anyone else to anything.

6. The referral service

If you ask to be contacted, we transmit the details you provide to one independent, appropriately licensed third-party professional serving your ZIP code. You should understand the following:

  • We are paid. We receive a flat referral fee, agreed in advance, for each qualifying referral. That fee is fixed and does not depend on whether you buy anything, on what you buy, or on the size of any job. We receive no commission, override, or payment contingent on a sale. This is also disclosed on every page and in our editorial policy.
  • Partners are independent. Each is a separate business. They are not our employees, agents, partners in the legal sense, joint venturers, or subsidiaries. We do not control their pricing, scheduling, workmanship, licensing, insurance, or conduct.
  • A referral is not a recommendation, endorsement, guarantee, or warranty of any professional's licensing status, competence, availability, price, quality of work, or conduct. It is an introduction, and nothing more.
  • You choose. You are under no obligation to hire anyone we introduce you to, and you are free to hire anyone else, including companies with which we have no relationship. Any contract you enter into is strictly between you and that professional.
  • Verify credentials yourself. We encourage you to confirm licence status directly with the Florida Department of Business and Professional Regulation, and to confirm insurance coverage with the professional before work begins.
  • We do not guarantee a response. We cannot guarantee that a partner will be available, will contact you within any particular time, or will agree to take the work. If your situation is urgent, do not wait on us — call a professional directly.
  • Consent is yours to give and to withdraw. Consent to be contacted is never a condition of purchasing anything, and you may withdraw it at any time by replying STOP to a text, telling a caller to stop, or using our opt-out form.

7. Information you submit

You are responsible for the accuracy of what you submit. You represent that any phone number or email address you provide is yours, or that you have the account holder's permission to provide it and to consent to contact at it.

We store a record of your submission, including a timestamp, a hash of the exact consent wording displayed to you, the page URL, and the referring URL, together with a third-party consent certificate. This exists so that there is an accurate record of what you were shown and what you agreed to. How this information is handled is described in the Privacy Policy.

Do not send us sensitive information. Please do not submit health information, government identification numbers, financial account numbers, or details of any legal dispute. We do not need them and we do not want to hold them.

8. Third parties and outbound links

We link to government agencies, standards bodies, and other external resources. We do not control those sites, we are not responsible for their content, accuracy, availability, or privacy practices, and a link is not an endorsement.

We are not affiliated with, endorsed by, or acting on behalf of FEMA, the National Flood Insurance Program, the State of Florida, the Florida Department of Business and Professional Regulation, the Institute of Inspection, Cleaning and Restoration Certification, or any other government agency or standards body. We cite them as sources. That is the entire relationship. Trade names and marks referred to on this site belong to their respective owners and are used for identification only.

9. Intellectual property

The text, structure, design, and compilation of this site are owned by FloodReady Florida or licensed to it, and are protected by copyright and other laws. The FloodReady Florida name and logo are our marks. Except as permitted in section 2, you may not reproduce, distribute, modify, or create derivative works from this site without our written permission.

If you believe material on this site infringes your copyright, contact us through the contact page with enough detail to identify the material and your claim, and we will investigate.

10. Disclaimer of warranties

This site and the referral service are provided "as is" and "as available," without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranty arising from course of dealing or usage of trade.

Without limiting the above, we do not warrant that:

  • the content is accurate, complete, current, or applicable to your specific property or situation;
  • cost figures, timeframes, standards, statutes, or licensing requirements described here remain current — they change, and we say so;
  • following any guidance on this site will prevent damage, mold growth, injury, or loss;
  • the site will be uninterrupted, secure, or error-free; or
  • any professional introduced to you is licensed, insured, competent, available, or suitable for your job.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, FloodReady Florida and its owners, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, use, or goodwill, arising out of or relating to your use of this site or the referral service — whether based in contract, tort, negligence, strict liability, warranty, or any other theory, and even if we have been advised of the possibility of such damages.

This expressly includes, without limitation, any damages arising from:

  • property damage, mold growth, personal injury, or loss occurring before, during, or after any water damage event;
  • reliance on any information published on this site;
  • the acts, omissions, workmanship, pricing, licensing, insurance, timeliness, or conduct of any professional introduced through this site; or
  • any decision made or not made about an insurance policy or a claim.

Our total aggregate liability for all claims relating to this site or the referral service will not exceed one hundred U.S. dollars (US$100.00).

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by our own negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless FloodReady Florida and its owners, officers, employees, contractors, and agents from and against any claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • your use of this site or the referral service;
  • your breach of these terms or of any applicable law;
  • information you submitted that was inaccurate, or that concerned a phone number, email address, or property you were not authorised to provide; or
  • any dispute between you and a professional introduced through this site.

We reserve the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, at your expense, in which case you agree to cooperate with us.

13. Governing law and venue

These terms and any dispute arising out of or relating to them or to this site are governed by the laws of the State of Florida, without regard to its conflict of laws rules. You and we agree that the exclusive venue for any action is the state or federal courts located in Florida, and you consent to personal jurisdiction there.

This site is directed to residents of Florida. We make no representation that the content is appropriate or available for use elsewhere, and those who access it from other locations do so on their own initiative and are responsible for compliance with their own local law.

14. Changes, termination and general terms

  • Changes. We may modify these terms at any time. The "Last updated" date at the top will change, and continued use of the site after that constitutes acceptance. Material changes will be flagged prominently.
  • Termination. We may suspend or terminate your access to the site at any time, for any reason, without notice — for example, in response to abuse or automated submissions. Sections 4, 5, 7, and 9 through 14 survive termination.
  • Severability. If any provision is held unenforceable, it will be limited or removed to the minimum extent necessary and the rest of these terms remain in full force.
  • No waiver. Our failure to enforce any provision is not a waiver of it.
  • Assignment. You may not assign these terms. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Entire agreement. These terms and the Privacy Policy are the entire agreement between you and us regarding this site, and supersede any prior understanding on that subject.
